How to Start a Business or Work as a ZZP’er in the Netherlands (2026)
Start freelancing or build a Dutch business with this guide to residence rights, KVK registration, legal structures, VAT, records and 2026 false self-employment rules.

Starting a Dutch business is relatively structured, but registering with KVK is only one part of becoming genuinely self-employed. Your immigration status must allow the activity, KVK and the Tax Administration use different tests, and the real working relationship matters more than the label on a contract.
Use this guide to map the process, then get personalised immigration, tax, or legal advice when your facts are complex.
ZZP Is a Way of Working, Not a Legal Structure
ZZP means self-employed without personnel. Freelancer is used in much the same way. Neither is a legal structure. Many solo professionals use an eenmanszaak or sole proprietorship; others choose a BV, partnership, or another form based on liability, tax, investment, and growth plans.
Check Your Right to Run the Business
EU/EEA and Swiss citizens can generally work as self-employed without a Dutch work permit, while non-EU nationals need a residence status that permits the activity. A highly skilled migrant permit tied to employment does not automatically authorise an unrelated freelance business. Check the wording on your residence document and the IND route before accepting work.
Does KVK Consider It a Business?
KVK looks at whether you independently provide goods or services, charge more than a symbolic amount, and regularly participate in the market. It may also consider your investment, continuity, number of clients, independence, and business risk.
The Tax Administration separately decides whether you are an entrepreneur for VAT and income tax. A KVK number therefore does not automatically unlock every entrepreneur tax deduction.
Choose a Legal Structure Carefully
Eenmanszaak
Simple to establish and common for freelancers, but the owner is personally liable for business obligations. Profit is generally handled through personal income tax, subject to the Tax Administration’s classification.
BV
A private limited company is a separate legal entity and requires a civil-law notary. It brings corporate administration and tax obligations and is not automatically cheaper or safer in every real-world situation.
Partnerships and cooperative structures can fit multi-founder businesses. Use the official legal-structure decision tool and discuss liability, profit, salary, investment, and exit plans with an adviser.
Register With KVK
- Define your activities, customers, pricing, business name, address, and start date.
- Confirm your residence right, BSN, DigiD, and address evidence.
- Complete the online KVK preparation and book the required appointment.
- Bring accepted identification and any documents for your legal structure or address.
- Pay the current registration fee and review the recorded activity codes.
- KVK passes relevant details to the Tax Administration, which determines VAT registration and sends tax identifiers where applicable.
Set Up Your Administration
- Use a dedicated business account even when it is not legally mandatory for your structure; clean separation simplifies records.
- Create legally complete invoices and number them consistently.
- Track income, expenses, VAT, contracts, hours, and business assets.
- Reserve cash for VAT and income tax instead of treating every payment as spendable income.
- Keep records for the statutory period that applies to each category.
- Use bookkeeping software or an accountant suited to cross-border income if relevant.
VAT and Income Tax Are Different
Most taxable businesses charge VAT at the applicable rate and file periodic VAT returns. Some activities are exempt, and small businesses may investigate the KOR scheme. Separately, annual profit can be subject to income tax or corporate tax depending on the structure and classification.
Do not advertise a tax deduction as guaranteed. Entrepreneur allowances have detailed conditions, may change by year, and do not apply merely because someone registered at KVK.
False Self-Employment in 2026
Under the DBA framework, the client and contractor share responsibility for assessing whether the relationship is truly independent. The Tax Administration looks at how the work happens in practice: who controls hours and methods, whose equipment is used, whether the work is integrated into the client’s organisation, entrepreneurial risk, and the wider commercial behaviour.
KVK states that enforcement tightened from 1 January 2025 and that additional assessments and possible fines can apply in 2026. A model agreement, BV, or invoice does not repair a relationship that functions like employment.
Protect the Business and Yourself
- Use written terms covering scope, fees, payment, intellectual property, confidentiality, liability, and termination.
- Consider professional, public, cyber, disability, and legal-expenses insurance based on the actual risks.
- Build your own pension and sick-leave buffer.
- Check professional qualification, permit, zoning, privacy, and sector rules before launch.
- Avoid dependence on one client without understanding the employment-classification risk.
A KVK registration starts the administration; genuine independence is shown by how the business really operates.
